As we head into the later part of our lives or as we experience medical challenges, it becomes essential to consider who will be in charge of making critical decisions in the event you can’t make them yourself.
Preparing advanced directives as part of your estate plan allows you to make these decisions in advance and ensure that your intentions are carried out clearly and effectively. When someone does not have directives in place, findings will often be left to the court to decide a representative that may not be familiar with your intentions.

Power of Attorney
A power of attorney is a person you appoint as your agent who is able to step into your shoes and execute transactions with regard to your person or property. This agent has a duty to act in your best interest.
Health Care Surrogate
A healthcare directive allows an appointed person to make decisions about your healthcare when you may not be able to. This designated person ensures your wishes and values are appropriately honored, and decisions are made that match your best interest.
If the decision-maker isn’t in place for healthcare decisions then it may be up to doctors or automatically appointed individuals by law to represent your needs, which may not allow for full autonomy or have someone in place who understands your unique needs.
Living Will
Preparing a living will means outlining your decisions if you require life-sustaining treatment and cannot advocate for yourself. For example, you may indicate your preferences regarding certain health interventions.
As the name suggests, a living will give instructions for your situation while still alive. This is opposed to a regular will which comes into place at the end of life.
Designation of Preneed Guardian
This advance directive allows you to decide who will represent you and your affairs in the case that you become incapacitated and require a legal guardian.
